Register your company first and your trademark second, and you can end up with a name you are entitled to trade under but not entitled to own. The commercial register and the trademark register apply different tests and neither one checks the other. Doing the trademark clearance before the incorporation costs almost nothing; reversing an established name costs a rebrand.

Setting up in Switzerland - common questions
Do I need to live in Switzerland to set up a company here?
No, but a Swiss company must be able to be represented by at least one person domiciled in Switzerland with signing authority.
Sàrl or SA: which should I choose?
It depends on capital, on how visible you want shareholders to be, and on how Swiss counterparties will read you. A Sàrl is lighter and its members appear in the public register; an SA carries a higher capital requirement and is the form most institutional partners and investors expect. We walk through the trade-offs against your actual plan rather than defaulting to one.
Can I use my company name as my trademark automatically?
No. They are separate registers applying separate tests, and an entry in one gives you no rights under the other. It is entirely possible to be granted a company name that infringes an existing trademark: the commercial register does not check for that. Clearing the name as a trademark before incorporation is the cheap version of this problem.
How long does incorporation take?
Once the articles, the capital payment and the notary appointment are lined up, the register entry itself is a matter of days rather than months. What sets the pace in practice is the preparation: clearing the name, deciding the structure, and getting documents from founders abroad certified. We front-load that work so the formal steps run without stops.
